The National Green Tribunal (NGT), Principal Bench, New Delhi, heard Original Application No. 1219/2024, initiated on the basis of a news report titled “KSPCB directs BBMP to redirect sewage flow in Kodichikkanahalli” published in The Hindu on 18.09.2024.
Key Developments
Replies from Karnataka State Pollution Control Board (KSPCB) and Central Pollution Control Board (CPCB) have been filed.
BBMP’s counsel informed the Tribunal that, following a recent administrative reorganization, maintenance of the Kodichikkanahalli waterbody now lies with the Greater Bengaluru Authority (GBA).
As BBMP no longer exists, the Tribunal substituted respondent no.1 with GBA, represented through its Chief Commissioner, Hudson Circle.
Concerns About Wall Construction Around Waterbody
Counsel for GBA sought four weeks to file a reply and stated that a wall surrounding the lake is under construction.
The Tribunal directed GBA to explain:
Why the wall is being constructed around the waterbody, and
Whether it blocks natural recharge channels.
Supreme Court’s Wetland Protection Guidelines to be Followed
The NGT reminded authorities that respondent no.5 – Karnataka Wetland Authority is responsible for protecting the waterbody, which is categorized as a wetland.
The Tribunal reiterated compliance of Supreme Court’s order dated 05.03.2019 in Mantri Techzone Pvt. Ltd., requiring buffer distances:
75 m from lakes
50 m from primary Rajkulewas (major stormwater drains)
35 m from secondary Rajkulewas
25 m from tertiary Rajkulewas
These areas are no-construction zones.

Karnataka Wetland Authority to file its reply within four weeks.
Respondents 4 and 6 also directed to file replies within four weeks.
On submission that preventing sewage discharge is the responsibility of Bangalore Water Supply and Sewerage Board (BWSSB), the Tribunal impleaded the Chairman, BWSSB as respondent no.7.
State counsel accepted notice and sought four weeks to file the reply.
The matter is posted for hearing on 24 February 2026.
